Jay D. Scott, 48, is scheduled to die by lethal injection on Tuesday if the U.S. Supreme Court either refuses to hear the case or denies his plea to be spared. He would be the first Ohio SCOTT inmate to be put to death against his will in 38 years. Later Friday, Scott's attorneys asked Gov.

Bob Taft for a seven-day reprieve, but spokeswoman Mary Anne Sharkey said the governor would not intervene. Taft earlier turned down Scott's request for clemency. Scott's attorneys say he is incompetent' to be executed because he suffers from schizophrenia, and that putting him to death would be cruel and unusual punishment under the U.S. Constitution. The state argued that no court has ruled that executing an inmate with Scott's condition violates the law and that two lower courts found no reason to spare Scott's life.

Scott has run out of appeals on the merit of his conviction and death sentence. The 23-year-old Mansfield man, who has been warned not to be there, was taking photos of his sister vomiting out the car window, police said. While at the apartment, the officer answered the woman's phone, and the ex-husband demanded to talk with her. When the officer told the man who he was, the caller terminated the call.

The officer called the number back, and a woman who answered swore at the officer and hung up, police reported. When the officer returned io the station, the man called, asking if he would be charged with phone harassment. When the officer asked the man to pick up the summons, he refused, adding he would have problems with the officer, police said. The man refused to say what type of problems, but threatened to sue the officer and the department. Officers attempted to contact the man, finally contacting his sister who said she would pass on the message that I Danny J.

Brandy Mane Kinstle and Jeffrey Scott Willis of Bellville. Justice Paul Pfeifer dissenting, upheld a Cuyahoga County Common Pleas judge's decision that Scott is competent to face execution. The majority acknowledged that schizophrenia is a mental illness but said the lower court correctly ruled that the illness did not prevent Scott from understanding the proceedings against him. The trial court fully considered defense medical testimony of Scott's illness, the majority said in an unsigned opinion. In his dissent, Pfeifer said evolving standards should not allow the execution of mentally ill people.

"This court has a chance toward being a more civilized and humane society. This court could declare that in the interests of protecting human dignity, the Ohio Constitution prohibits the execution of a convict with a severe mental illness," Pfeifer wrote. Pfeifer's dissent was good news to Timothy Sweeney, one of Scott's court-appointed attorneys, who had argued that the ban on executing the insane should be extended to include the mentally ill. "I think that's encouraging. He agrees with our argument that society has changed and standards have developed," said Sweeney, who added that he would ask the' U.S.

Supreme Court to review the case and postpone Scott's execution. Attorney General Betty he was charged with phone harassment, and the summons would be mailed. Sturgis Apartments, 5 1 Srur-gis Mansfield Thursday at 2:30 p.m., the Mansfield Fire Department responded and found that lighter fluid had been poured around the outside of the building. The Mansfield Police Department was called to the scene, and the area Montgomery will oppose the appeal, spokesman Joe Case said.

"We now have the highest court in the state of Ohio affirming the state's argument that Mr. Scott is competent to face execution under Ohio law," Case said. Cuyahoga County Prosecutor William Mason, whose office secured Scott's conviction and sentence in 1984, praised the court's ruling: "The time has come to carry out the sentence of the court." A Cuyahoga County Common Pleas jury convicted Scott of aggravated murder for killing Vinnie Prince, 74, during a robbery. The next day, Scott killed a security guard in another restaurant for which he received a second death sentence. However, that penalty was overturned after it was discovered that a juror had known about the previous sentence.

Ohio law says an inmate is competent to be executed if he knows of the proceedings against him, why he is being executed and that he will die as a result of the sentence. A Cuyahoga County Common Pleas judge ruled April 16 that Scott is competent to face execution. The next day, the Ohio Supreme Court postponed his execution 65 minutes before it was to take place so the 8th Ohio District Court of Appeals could have time to consider the case. was washed down with fire hoses. 100 block Pat Lane A 38-year-old man reported his residence nad been entered by force through a door.
