MANSFIELD A proposed settlement over repair of sinkholes in Madison Township roads was discussed behind closed doors by Richland County commissioners Tuesday. The commissioners reportedly reviewed the settlement with legal counsel before sending it to a law firm that represents Kokosing Construction Co.

of Fredericktown, the primary contractor on the $19 million Madison East Sewer Project in the mid-1990s. There was no public discussion of the proposed settlement. Details of the settlement were not revealed. Sinkholes developed under roads that cross the sewer line because gravel used to fill the trench was not properly compacted, according to a report by a Franklin County engineering firm hired by the commissioners In the wake of that report the commissioners filed a civil lawsuit against Kokosing, two Richland County firms which designed the sewer system Richland Engineering Limited and K.E. McCartney Associates and others, alleging breach of contract and negligence.

The cost of repairing the sinkholes has not been determined, although one estimate given at a commissioners' meeting last summer set the figure at a minimum of $100,000. Sheriff's Capt. Larry Faith said Tuesday other business has prevented him from beginning the investigation into whether the county was billed for inspections that were not done. Richland Engineering and K.E. McCartney have denied any wrongdoing and said they would cooperate fully with the sheriff's office.
